By accessing or using Fresh Start (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes take effect constitutes acceptance.
2. Description of the Service
Fresh Start provides educational guidance, eligibility assessments, and document preparation tools related to criminal record expungement and sealing in the United States. The Service is informational in nature and does not constitute legal advice, representation, or a substitute for a licensed attorney.
3. No Attorney-Client Relationship
Use of the Service does not create an attorney-client relationship. Fresh Start is not a law firm and does not practice law. AI-generated assessments, action plans, and analyses are educational estimates based on the information you provide and general legal principles; they may be incomplete or inaccurate for your specific situation. You should verify all requirements with your local court or a licensed attorney before relying on any output or filing any document.
4. Your Responsibilities
You agree to: (a) provide accurate and complete information about your case; (b) review all generated documents before filing with any court; (c) use the Service only for lawful purposes and only in connection with your own record or a record you are legally authorized to address; and (d) not misuse, reverse engineer, or disrupt the Service.
5. Account and Eligibility
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
6. Subscriptions and Payments
Access to some features may require a paid subscription, as described on our Pricing page. Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees paid are non-refundable except where required by law.
7. Intellectual Property
The Service, including its design, content, and generated document templates, is owned by Fresh Start and protected by intellectual property laws. You retain ownership of the personal information you provide and the final documents you prepare using the Service. You may not copy, modify, or redistribute the Service's content without permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ELIGIBILITY ASSESSMENTS OR GENERATED DOCUMENTS WILL BE ACCEPTED BY ANY COURT. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FRESH START AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON THE SERVICE, INCLUDING ELIGIBILITY DETERMINATIONS, GENERATED DOCUMENTS, OR DELAYED OR DENIED PETITIONS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless Fresh Start and its affiliates from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your filing of documents prepared through the Service.
11. Governing Law and Disputes
These Terms are governed by the laws of the United States and the state in which Fresh Start operates, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless otherwise required by consumer protection law applicable to you.
12. Termination
We may suspend or terminate your access to the Service if you violate these Terms or misuse the Service. You may stop using the Service and delete your account at any time.
